By accessing or using Sendbar ("Service"), operated by Sendbar Pty Ltd ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Sendbar is an email template management and delivery platform that allows users to:

• Create and manage email templates
• Send transactional and marketing emails
• Track email engagement and analytics
• Manage contacts and recipient lists
• Configure custom sending domains
• Access email functionality via API

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be responsible for all activities under your account

You agree NOT to use the Service to:

• Send spam or unsolicited bulk emails
• Send emails without proper consent from recipients
• Distribute malware, phishing attempts, or fraudulent content
• Violate any applicable laws or regulations (including CAN-SPAM, GDPR, etc.)
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

When sending emails through Sendbar, you must:

• Only send to recipients who have opted in to receive your emails
• Include a valid physical mailing address in marketing emails
• Provide a clear unsubscribe mechanism
• Honor unsubscribe requests promptly
• Use accurate sender information and subject lines
• Comply with all applicable email regulations in your jurisdiction

Billing

• Paid plans are billed monthly in advance
• All fees are non-refundable unless otherwise stated
• Prices may change with 30 days notice
• You are responsible for all applicable taxes

Usage Limits

• Each plan has specific limits on emails, templates, and domains
• Exceeding limits may result in service restrictions or additional charges
• We will notify you when approaching your limits

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• Your data will be retained for 30 days after cancellation

Our Property: The Service, including its original content, features, and functionality, is owned by Sendbar Pty Ltd and protected by intellectual property laws.

Your Content: You retain ownership of content you create or upload. By using the Service, you grant us a limited license to process your content as necessary to provide the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The Service will be uninterrupted or error-free
• All emails will be delivered successfully
• The Service will meet your specific requirements
• Any errors will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENDBAR PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Sendbar Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you send through the Service

We may suspend or terminate your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data after 30 days
• Provisions that should survive termination will remain in effect

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
